TrueClime may create, use, retain, analyze, disclose, license, sell, or otherwise commercialize data that has been aggregated, anonymized, de-identified, statistically transformed, generalized, or derived from information provided to or developed by TrueClime, including business, building, HVAC, operational, equipment, telemetry, energy, maintenance, retrofit, climate, load, and performance-related information.

This may include data products, benchmarks, market insights, trend analyses, performance comparisons, system-type comparisons, climate-zone analyses, equipment-category analyses, anonymized case studies, statistical outputs, model inputs, research datasets, dashboards, reports, and other derived insights.

TrueClime may provide such data or insights to third parties, including:

  • HVAC manufacturers and OEMs;
  • municipalities and city governments;
  • utilities;
  • energy organizations;
  • consultants;
  • engineering firms;
  • researchers;
  • investors;
  • sustainability organizations;
  • standards or policy stakeholders;

TrueClime will not intentionally include personal identifiers in de-identified data products. Where appropriate, TrueClime will also remove, generalize, mask, aggregate, or transform information that could reasonably identify a specific individual, customer, building, address, owner, tenant, or organization.

4. Public Commitment to Maintain De-Identified Data

TrueClime publicly commits to maintaining and using de-identified data in de-identified form and not attempting to re-identify de-identified data, except where necessary to test, validate, improve, audit, or confirm the effectiveness of our de-identification processes or as otherwise permitted by law.

TrueClime will use reasonable technical, administrative, and organizational measures designed to reduce the risk that de-identified data can be associated with a particular individual, household, customer, building, owner, tenant, or organization.

TrueClime will contractually require recipients of de-identified data products, where appropriate, not to attempt to re-identify the data and not to use the data to identify, contact, target, profile, or make decisions about any specific individual, customer, building, owner, tenant, or organization.

This commitment is intended to align with common privacy-law expectations for de-identified information, including requirements that organizations use reasonable measures, publicly commit not to re-identify, and contractually restrict downstream recipients from re-identification.

5. Sale or Licensing of De-Identified Data Products

TrueClime may sell, license, disclose, distribute, provide access to, or otherwise commercialize de-identified, anonymized, aggregated, statistical, or derived data products.

Such data products may be used by recipients for purposes such as:

  • market research;
  • product development;
  • system benchmarking;
  • equipment performance research;
  • energy planning;
  • public policy;
  • grid or utility planning;
  • municipal planning;
  • sustainability analysis;
  • investment analysis;
  • retrofit-market analysis;
  • HVAC industry research;

TrueClime does not consider properly de-identified or aggregated data to be personal information. 6. No Sale of Personal Information for Money

TrueClime does not sell personal information for money.

TrueClime's intended data-commercialization model is based on de-identified, aggregated, anonymized, statistical, or derived data products that are designed not to identify a particular individual.

If TrueClime later engages in activities that constitute a "sale," "sharing," or "targeted advertising" involving personal information under applicable privacy law, TrueClime will update this Privacy Policy and provide required notices and opt-out rights.

7. Customer, Building, and Operational Data Rights

If you provide building, HVAC, operational, utility, equipment, telemetry, controls, maintenance, energy, performance, financial, ESG, or other project data to TrueClime, you represent that:

  • you have the legal right and authority to provide the data;
  • providing the data does not violate any law, contract, lease, policy, cybersecurity obligation, confidentiality obligation, privacy obligation, or third-party right;
  • the data does not include personal information, sensitive information, regulated information, or third-party confidential information unless properly authorized;
  • the data is reasonably accurate and complete to the best of your knowledge.

Unless otherwise stated in a separate written agreement, TrueClime may use submitted data to:

  • evaluate opportunities;
  • communicate with you;
  • prepare proposals;
  • provide services;
  • improve services;
  • develop analytics;
  • create derived insights;
  • create aggregated or de-identified datasets;
  • create commercial data products;
  • maintain business records;
  • protect TrueClime's rights.

Specific customer projects may be subject to additional written agreements. If a customer does not want TrueClime to create, use, sell, license, or commercialize de-identified or aggregated outputs derived from project data, that restriction must be expressly stated in a written agreement signed by TrueClime.

8. Confidential Information and De-Identified Data

TrueClime may receive confidential business information under a nondisclosure agreement or separate written agreement. TrueClime will handle confidential information according to the applicable written agreement.

However, unless a written agreement expressly states otherwise, TrueClime may use, retain, analyze, disclose, sell, license, or commercialize aggregated, anonymized, de-identified, statistical, or derived information that does not reasonably identify the customer, individual, building, owner, tenant, project, or organization.

This section is important because de-identified data products may be valuable to TrueClime's business model.

9. How We Disclose Information

  • CRM providers;
  • email and scheduling tools;
